Here in Vermont it's at the Wardens descretion on weather you keep the animal or not....
Usually any state uses your tag fee's for conservation, and salaries of wardens and such.....![]()

Here in RI you can keep the deer normally. The DEM has to come over to band it. Of course your car is totaled but insurence normally handles that.
if i remember right someone told me that in the state oflahoma if you hit a deer you have first right to itand they will give you a special tag for it. thenyou can take it for whatever your having sdone to it. if it has a great set of horns you can have them mounted but it is considered a hit deer and has the sepcial tag for it

There is a roadkill law here that allows people to legally take roadkill without using any tags.
Deer are a resource that needs to be managed, so the state gets saddled with that management. To make the state liable for accidents is a little silly IMHO.
Can't pick up a roadkill in Texas. That's probably why we see so many laying beside the highway. I counted 8 dead bucks and at least that many does over a hundred mile stretch last Friday afternoon.
In VT the state does consider the deer property of the state but is not held reasponsible for the action of any wild animal.
The state "owns" the responsability of managing the deer and administering game laws. They do not own the deer.
Even if they did own the deer, asking the state to pay for an accident is like suing the neighbor when you run over his dog...just plain sick!

Minnesota and Indiana for sure the deer is yours if you want it. The police have a metal band that they tag the deer with similar or same as the check-in stations do.
If you don't want it, usually the state or county police have a list of people that they call and ask if they want the deer - I think those people on the list are called in rotation.
In NY, you can take the deer once the troopers tag it.
